Resident Threatens Suit Against Hopatcong Land Use Board – Allegations of Conflict, 1st & 14th Amendment Violations

A Local Hopatcong Resident sent an official notice to the Land Use, stating the intent to sue after his comments from the last meeting were rejected in not removing the Borough Attorney.

The intent of the Homeowner was to prove that the Borough Engineer had a conflict of interest that may have come from a different office where he does not work. The Borough Engineer explained to the resident, he has no knowledge of the proceedings and therefore felt no need to excuse himself.

The Land Use Board spent considerable time trying to understand the 1st & 14th amendment violations as stated in the letter.

FYI:

Note: The conversation continued, and we urge every view to please review the two videos from the two meetings to fully context of this complaint. We also attempted to contact the owner, but could not find a listing.

During the second meeting the Board still found his application lacking all of the following areas that are standard by Borough Ordnance:

  • No Flood Water Control on the Stream
  • Disturbance of Lot Grading Plan (Not Submitted)
  • Does not contain Storm Water Control Requirements (Not Submitted)
  • Existing and Contour Plans are missing
  • Construction Details are Missing
  • Utility Points are Missing

The final vote by the Land Use Board was to vote the application incomplete as it sends now.
